1. Acceptance of Terms
By registering as a member, purchasing a class pass, enrolling in any program, or using the website at montraitmuaythai.com, you agree to be bound by these Terms of Service with Montrait Muay Thai and Fitness (“MMT”). These terms apply to all programs: Foundations Muay Thai Program, Foundations Muay Thai Class, Kids Muay Thai Program, and Intermediate/Advanced Program.
2. Eligibility & Minors
Adult membership is open to individuals 18 years of age or older. Minors may participate in the Kids Muay Thai Program and other designated youth programming with the express written consent of a parent or legal guardian. The parent or guardian assumes full responsibility for the minor’s participation and conduct. MMT reserves the right to require a guardian to be present during classes and to refuse membership to any individual at our discretion.
3. Memberships & Fees
All prices are in Canadian dollars. Recurring memberships are billed monthly; by enrolling you authorize MMT to charge your payment method on the billing date. Class passes are valid for the period specified at purchase and are non-transferable. Program fees are charged per cycle as outlined at enrollment. Failed payments may result in suspension of access until the outstanding balance is resolved.
4. Cancellation & Refunds
You may cancel a recurring membership by providing written notice at least 14 days before your next billing date. Cancellations received after this window may result in one additional charge. Prepaid memberships and class passes are generally non-refundable, except where required by Ontario consumer protection law. Program fees are non-refundable once a session has commenced. Requests for exceptions due to documented medical reasons will be considered case by case. If MMT cancels a class or program, members will receive a credit or pro-rated refund.
5. Member Conduct
Members must: follow all coach and staff instructions; treat others with respect (harassment or discrimination of any kind will result in immediate removal); arrive on time with appropriate gear; disclose injuries or medical conditions before class; refrain from unsupervised sparring; maintain hygiene appropriate for a contact sport. MMT reserves the right to suspend or permanently revoke membership for conduct violations, without refund.
6. Assumption of Risk
Muay Thai and martial arts training involve inherent physical risks including strains, sprains, fractures, and other injuries. By participating you voluntarily accept these risks, confirm you are physically capable of participating, and agree to inform coaches of any health changes. A separate Liability Waiver is required before participation.
7. Limitation of Liability
To the fullest extent permitted by Ontario law, MMT, its coaches, staff, and affiliates are not liable for injury, loss, or damage arising from participation in MMT programs or use of MMT facilities. MMT is not responsible for loss or theft of personal property on the premises.
8. Photography & Media
MMT may photograph or video record classes and events for marketing, social media, and the website. By participating you grant MMT a non-exclusive, royalty-free license to use your likeness. If you do not wish to be recorded, notify us in writing before your first class. Members may not record other members or coaches without their express consent.
9. Website Use
The website is for informational and administrative use related to MMT services. You agree not to use it for unlawful purposes, attempt unauthorized access, or reproduce content without permission. These Terms are governed by the laws of the Province of Ontario.
